There are cases of people who get passports for their children so that they can take them away from another parent and live in another country. There are other cases in which both parents willing get their child a passport and as a family move to another country. Sometimes those marriages don’t work out and one parent wants to return back home. What happens to the child? A recent case in Clarksville, Tennessee involves Charles Peters, his wife Stacy and their infant daughter.
The couple lived with their child in Dubai. The husband allegedly kicked his wife out of their home in Dubai where he had been employed as a military consultant. The wife used her passport to return back to Tennessee and the husband remained in Dubai with his infant daughter.
A judge has ruled that the former US Army major must return to the United States with his daughter and surrender his US passport.
The judge found that Charles Peters’ actions fall into the category of child abduction and kidnapping.
Charles Peters maintains that upon learning of his wife’s infidelity, he filed a case of adultery against her. She quickly gathered her US passport and fled back home to Tennessee.
Meanwhile, according to the Tennessee judge’s ruling, Charles Peters must pay child and spousal support and must return with his daughter and surrender his passport.
The judge also granted Stacy Peters or a representative the right to go to the United Arab Emirates to retrieve their daughter.
The wife is concerned that getting the child and husband to return may be difficult because Dubai is not a part of the 1980 Hague Convention on the Civil Aspects of International Child Abduction. In addition, US court orders are usually not recognized in Dubai.
