The citizenship laws regarding how a child may be eligible for a US passport has changed through the years.  At the time of birth, children automatically acquire US if they satisfy the following requirements:

  • both parents were US citizens
  • they were married
  • one parent had lived in the US

If the parents were unmarried, then the mother has to have proof that she lived in the US for at least one year before the child’s birth and paternity in writing must be legitimized before the child’s 18th birthday.

Some people do not know that their children are eligible for US passports.  They think that because the children were born overseas that they are not eligible to apply for US passports.  However, due to the citizenship laws, their children may be eligible for a US passport.

Do I Need a New Passport if My Appearance Has Changed to the Point that I am Unrecognizable?

passport photoDo I need a new passport if I don’t look like the person in the passport photo anymore?  Passport photos don’t always do the passport holder justice.  But, there are times when the passport doesn’t look anything like the passport holder.  I’m not talking about fake passports, I’m talking about a person whose passport photo doesn’t look like them at all.  The adult US passport is valid for ten years.  A lot can happen to a person’s appearance in ten years that can make their passport photo unrecognizable. 

The most common change that a person can undergo in ten years is to their hair.  Hair can turn gray, it can be dyed different colors or it can fall out completely.  A person can grow or shave off facial hair.  But, for the most part, it may be unlikely that hair would change so much that the passport holder would be detained due to concerns that the passport is not theirs. 

However, a person’s weight may fluctuate in ten years to the point where they may be unrecognizable with regard to their passport photo and their appearance in person.  People may experience such a drastic weight gain or weight loss in ten years that they look nothing like their passport photos.

A person’s passport may not be accepted for travel by border officials if their appearance has changed to the point at which they cannot be identified from the photo in their passport.   If this is the case, the person should apply for a new passport, even if the old passport has not yet expired yet.

In addition to changes to hair and weight, there are other instances in which a person may need to apply for a new passport due to concerns over the passport photo matching their appearance.  Anyone who has undergone significant facial cosmetic plastic surgery or trauma to the face may need to apply for a new passport.  A person with added or removed facial piercings or tattoos may also need to apply for a new passport.  Another reason that a person may need to apply for a new passport is if they have undergone a transgender procedure.

Last, but not least, a child may get an adult passport at age 16 and may have aged so drastically before the 10 years of the passport’s validity is up that they need to apply for a new passport.

If you feel that you are unrecognizable from your passport photo, you can apply for a new passport.  If you think that you can still be identified from your passport photo, then you do not need to apply for a new passport.

How Long Does it Take to Get a Passport?

How long does it take to get a passport?  To answer the question of how long it takes to get a passport depends on several factors.  When, where and how you apply for a passport can affect the amount of time it takes to receive your passport.

  1. When You Apply For a Passport. Time may vary depending on the time of year that you choose to get your passport.   Traditionally, the busiest time of the year to apply for a passport is during the summer months.  During off-peak periods, getting a passport may be quicker.

Should English be required to get a passport?

No English = No Passport?  What do you think?  According to an article in The Telegraph, the latest translation bill makes a joke out of the Government’s pledge that migrants planning to reside in the UK must demonstrate a command of the English language.  People applying for a passport should have already passed a citizenship test and are expected to be able to answer basic questions.  However, translators are still needed for some newcomers at the latest face-to-face interviews.  Some experts feel that it is downright absurd that interpreters are provided for people who according to the rules must be able to speak English in order to qualify for a passport.

While the government’s pledge of ensuring that the issuance of a passport is conditionally based on being able to speak the English language, it seems counterproductive to provide translators.  In the meantime, the passport office continues to spend a vast amount of public funds on translation and interpretation services for passport applicants who can’t speak English. 

Face-to-face interviews for adult passport applicants became mandatory in an attempt to prevent passport fraud.  The interviews, conducted in order to securely establish identity, can last up to 20 minutes.  During the interviews, passport applicants are questioned on personal information such as bank accounts and past addresses.  Without translators present, the interviews could not be completed accurately.  Even though the majority of passport applicants have been in the country for at least five years, most of them still need interpreters.

The British government is determined to ensure that British passports remain one of the most secure passports in the world.  A Home Office spokesman stated “To become a British citizen, and apply for a passport, people must speak English, work hard and play by the rules. It is crucial that these interviews securely establish identity – therefore on occasion an interpreter may be called to assist. This can help satisfy us that the person attending the interview is the legitimate passport applicant.”

So, for now in England, speaking the English language is not a requirement for a passport.  Only the future will hold the answers that will determine the fate of the next crop of passport applicants.
